The Monroe County Apartment Association is pleased to announce our partnership with Ivy Tech in support of their Youth Summer Scholarships. The MCAA presented a check to Ivy Tech in the amount of $10,000 on April 22, 2014. SMOKE DETECTOR LAWSUIT
A summary judgment was granted by the Court in favor of our lawsuit. The Court found that the ordinance is not enforceable because it conflicts with Indiana law by prohibiting something that the State statute expressly permits (battery operated smoke detectors).
The Court also found the ordinance is unenforceable because the City failed to get State Commission approval. Although the City argued that the ordinance might regulate a building that was built before the Commission came into existence (and was not required to have smoke detectors), the ordinance was not written as being limited to buildings constructed before the Commission was created.
The City did not challenge the judgment.
